Whilst at the rally Tom saw the car and said to Bert, “Your Jowett Javelin what would be the best price you would accept for it”? Bert replied, “I wouldn’t take less than £10,500 for it” On Monday Bert decided to advertise his car for sale so he placed the following advert in “Vintage Car Magazine” “1955 Jowett Javelin excellent condition £11,000 or nearest offer” On Wednesday William saw the advert and went to see the car and said to Bert “Your Jowett Javelin, I will offer you £10,000 for it, Bert replied “I will accept £10,500, but I will not sell it to anyone else before Saturday, please let me know by Friday if you want it”. On returning home William phoned Bert and left a message on his answering machine stating “I accept your offer”. Unfortunately Bert’s infant son pressed a button on the machine which erased the message before Bert heard the recording. Later that day Bert sold the car to Harry for £10,750. On Thursday, William saw Harry’s old mother who told him she had seen her young grandson, who told her that his father had just bought a Jowett Javelin. On hearing this William rushed home and posted a letter to Bert stating “I accept your offer of £10,500”. Also on Thursday Tom, who hadn’t had any contact with Bert since the rally also wrote a letter to Bert stating “I accept your offer of £10,500. On Thursday afternoon Bert wrote to William withdrawing his offer. At 9.00am on Saturday William received Bert’s letter and at 1.00pm Bert received William’s letter. Advise Bert
